The assessment of risk in all children’s cases is a constant in the lives of Family Law practitioners in their preparation of those cases for Court. In his presentation, Tony identifies the history of how the Courts have considered the standard of proof required to determine unacceptable risk – from Briginshaw, M & M, Fitzwater to Isles & Nelissen. Tony offers insight on the practicalities when dealing with child abuse cases and identifies the standard of proof now required in the assessment of risk – of a positive finding of abuse or a predictive finding of a risk of abuse.

Emma Swart practices predominantly in family law and appears regularly in the Federal Circuit and Family Court of Australia and, occasionally, in the Family Court of Western Australia. She is a Nationally Accredited Mediator and Victorian Bar Advanced Mediator, and FDRP and Family Law Arbitrator. She joined the Victorian Bar in 1998 and this year celebrates 25 years as a barrister.

Stephen Page is a director of Page Provan, Brisbane. Stephen was admitted as a solicitor in 1987 and has been a Queensland Law Society family law accredited specialist since 1996. He has spoken extensively about family law, domestic violence and fertility law at local, national and international conferences. Stephen is a Fellow of the International Academy of Family Lawyers (including co-chair of the Sexuality and Gender Identity Committee) and of the Academy of Adoption and Assisted Reproduction Attorneys, and is an international representative on the ART Committee of the American Bar Association. He has received a number of awards, including the Queensland Law Society President’s Medal (2023). Stephen has written many legal articles. He is the author of two books: When Not If: Surrogacy for Australians (2022) and International Assisted Reproductive Technology (2024). Stephen is a member of several committees. He is the Secretary of the Fertility Society of Australia and New Zealand.
Mr. Jahan Kalantar, Managing Partner, and Head of Litigation, Executive Legal
Jahan Kalantar is a Sydney-based lawyer, university lecturer, and entrepreneur who describes himself as a ‘little guy lawyer’. When not in practice, Jahan is a highly sought after speaker and workshop facilitator who brings his practical skills from the courtroom to help people take their skills to the next level. He frequently speaks to groups of entrepreneurs, high performers, students and the community about storytelling, community building, mental health and the power of communication. Jahan’s keynote work focuses primarily on the skills and expertise developed while working in the law and how to tailor your communication for the audience. His work was recognised by TedX Sydney who invited him to speak on the main stage and his talk has been viewed over 386k times.

Danny is an Accredited Specialist in Family Law and is a Graduate Fellow of the College of Law having also completed a Master of Laws (Applied Law, Family Law) degree. Danny has a Bachelor of Laws and Bachelor of Arts (International Studies) degree from the University of Technology, Sydney. He is currently completing a Graduate Diploma of Family Dispute Resolution Practice through the College of Law. Anthony (Tony) George was called to the Bar in 1980 and has specialised in all aspects of family law and has appeared in all jurisdictions since then – from the Childrens and Magistrates Courts through to the Full Court of the Family Court. Tony is regularly briefed to appear on behalf of the Independent Children’s Lawyer in parenting matters. He continues to accept Legal Aid work. During more than 35 years of practice, Tony has delivered numerous papers at seminars and conferences, and has participated as a mentor, facilitator and “judge” in University and Bar Practice courses on professional development, and in training courses on negotiation and mediation. Tony is member of the Family Law Section of the Law Council of Australia, and of the Family Law Practitioners Association of Queensland (FLPA). He is also a member of the Queensland Bar Association’s Family Law sub-committee.
