Brett Young, National Tax Director, Nexia Australia

Variation of Trust

Varying a trust can have significant legal, taxation, and succession consequences if not carefully managed. This session explores the principles governing trust variations, including amendment powers, beneficiary considerations, resettlement risks, and the circumstances in which court approval may be required. Practical guidance will also be provided on implementing variations effectively while minimising disputes, unintended tax outcomes, and challenges to the validity of trust changes.
