Lydia has practiced at the Victorian Bar since 2004 mainly in commercial disputes, insolvency and wills & estates with a strong interest in equity. While Lydia enjoys the challenge of preparing a case for litigation, accredited as a mediator in 2004 and nationally accredited in 2008 she also aims to facilitate non-litigious outcomes wherever possible. In addition to her legal skills, Lydia previously managed a range of businesses resulting in a high level of financial literacy – which has proven to be vital to managing the sometimes erratic nature of Bar Practice and in her role as a director of a not-for profit board managing a retirement facility. Lydia considers all her interests have been enriched by her training in professional responsibility and ethics.

Temple is a commercial barrister and nationally accredited mediator. She accepts briefs to advise, appear and mediate. Temple’s experience includes: Acting for parties in various bankruptcy and insolvency proceedings including public examinations, insolvent trading claims, preference payment claims, winding up hearings and creditors petitions. This area of Temple’s practice also includes acting in matters where there are claims for breach of directors’ duties. Elly Phelan, Barrister, 9 Wentworth Chambers
Elly has a broad practice with specialist expertise in commercial litigation, domestic and cross-border insolvency, and white-collar crime. Elly has appeared both led and unled in the Supreme, District and Local Courts of New South Wales including in contested interlocutory and final hearings. Since her call to the Bar, Elly has been briefed in cross-border insolvency cases, class actions, and fraud cases for both the Crown and defence. Elly has also acted for the Commonwealth of Australia in whistleblower and insolvency matters. Prior to her call to the Bar, Elly was a Federal Prosecutor in the Commercial, Financial and Corruption branch of the Commonwealth Director of Public Prosecutions, and a solicitor at Gilbert + Tobin. Elly has a decade of experience in boutique and national firms in Brisbane and Sydney, and has completed Advanced Certification in Insolvency with the Australian Restructuring Insolvency and Turnaround Association.
Jason Polese, Barrister & Mediator, Clarence Chambers
Jason practises in general commercial litigation, with a keen interest in consumer law, property and employment. Jason has appeared and been involved in all NSW civil jurisdictions, including the NCAT, Local Court, District Court, Supreme and Federal Courts, on a wide variety of matters including, business and commercial disputes, corporate litigation including statutory demands and winding up, bankruptcy, partnership matters, employment, equity and trust matters, and debt recovery. Prior to being called to the Bar, Jason worked as a solicitor in small firms, with a hands-on approach to clients. Previous to being admitted as a Lawyer, Jason was a hospitality Guru, managing employees and businesses for large restaurant groups, international hotels and running businesses of his own. As a Lawyer, Jason has brought this business “know-how” to assist commercial clients with his insight and understanding of the business and hospitality domain.
