  • The legal status of notices by ASQA of either its Intention to Make a Decision or Notice of Decision: the available approaches to accepting an invitation from ASQA to respond to such notices, including the provision of evidence and submissions
  • Understanding ASQA’s primary focus and concerns arising from its Assessment Reports/Audit Reports and Statements of Reasons and preparing targeted responses to findings and legal submissions responding to its Reasons for Decision
  • How to prepare responses to findings of noncompliance and correlating them to legal submissions opposing ASQA’s intended decision or its decision
  • Preserving the status of the RTO by delaying the implementation of any decision pending internal review and, in some circumstances, anticipating an application to the Tribunal for merits review and preparing evidence and submissions in connection with internal review to minimise the scope and timeframe of a substantive Tribunal hearing and to obtaining a stay order from the Tribunal

Experienced in commercial and other litigation, in the last 10 years he has increasingly focused on assisting Registered Training Organisations (RTOs) and Higher Education Providers in their respective dealings with the Australian Skills Quality Authority (ASQA) and the Tertiary Education Quality and Standards Agency (TEQSA) and State and Federal Government funding provisions. Represented RTOs and HEPs in numerous applications to the AAT and the Federal Court in review applications and appeals and in State Courts and administrative bodies in connection with funding and related contracts.

Michael Byrnes, Partner, Swaab
Michael Byrnes is a partner of Swaab. He is a workplace relations lawyer with over 20 years' experience in assisting clients navigate employment and work health and safety issues. He also drafts and reviews workplace policies and undertakes complex and sensitive workplace investigations. Angus O’Brien, Barrister, Gerard Brennan Chambers
Angus has a general commercial and public law practice. He has broad experience in contractual disputes, corporations and insolvency, energy and resources, construction, commercial equity, competition law and administrative law matters. Prior to returning to the Queensland Bar, Angus practised at leading commercial chambers in Sydney and London. Angus received a Bachelor of Arts and Bachelor of Laws (First Class Honours) from the University of Queensland and was ranked first in his year. He also holds a Masters of Laws (First Class Honours) from the University of Cambridge. Angus was an Associate at the High Court of Australia to the Hon. Justice (later Chief Justice) SM Kiefel AC.
